1. General provisions

D.A.D. Foods, registered under Profit Suisse AG, Zugerstrasse 32, 6340 Baar (hereinafter referred to as D.A.D. Foods), operates an online e-shop. The offer is aimed at private individuals aged 18 and over who are resident in Switzerland and legal entities domiciled in Switzerland and the Principality of Liechtenstein. The delivery area is limited to the territories of Switzerland and the Principality of Liechtenstein. These GTC apply to all steps in the ordering process handled via the online e-shop, in particular to the registration and storage of customer data, ordering, delivery, payment, customer service and complaints and use of customer data. The use of customer data is governed by the privacy policy. Express reference is made to the Privacy Policy, which is to be considered an integral part of these GTC.

2. Order

How can orders be placed?

Orders for food parcels are placed online only. For large individual orders and price information, please contact us directly at info@dadfoods.ch.

Assortment and product information

The assortment in the online shop may differ from the current stock and availability of D.A.D Foods’ products. D.A.D Foods makes every effort to provide accurate product quantity information. The product information published in the online shop is updated regularly with the greatest care. In exceptional cases, there may be deviations from the details printed on the product label. In such a case, the information on the label takes precedence. The customer must always check the product label for specific information on allergies, intolerances, diabetes, etc. before consumption.

Order Placement / Contractual Relationship

The customer completes the online order process by clicking on the “Submit Order” confirmation button. The customer cannot change the content of the order after clicking on the confirmation button. By clicking on the confirmation button, the customer confirms the accuracy of the information provided by him. By clicking on the confirmation button, the customer makes a binding offer to purchase the ordered products. The customer receives a confirmation e-mail immediately after completing the order process. This confirmation e-mail from D.A.D. Foods constitutes acceptance of the offer. Until this confirmation e-mail is sent, there is no contractual relationship between the customer and D.A.D. Foods. D.A.D. Foods may decide not to accept an order and not to confirm it. Orders may be placed in designated time slots limited by the food manufacturer’s production capacity. Due to the nature of the product and its long shelf life, D.A.D. Foods reserves the right to postpone delivery of the product for up to 30 days after the specified delivery date indicated when the order was placed. Customers will be informed by email of the exact delivery date by our exclusive delivery partner DPD Switzerland.

Changes and cancellations of orders

Orders can only be changed if the customer has not yet clicked on the “Submit Order” confirmation button to complete the order process. Once the customer has clicked on the confirmation button and thus submitted their offer to D.A.D. Foods, the order can no longer be changed. If the customer wishes to cancel the order, they must contact Customer Service. Orders can be cancelled by the customer contacting customer service. Customer Service can be reached at info@dadfoods.ch. The cancellation is only valid if it has been confirmed by Customer Service. D.A.D. Foods reserves the right to cancel orders. In this case, the customer will be notified by email before the goods are dispatched and a full refund will be sent to the customer within 15 business days.

3. Delivery

Delivery is handled by our exclusive partner DPD Switzerland. Goods are only handed over in person and must be confirmed with the customer’s signature. Goods may not be left at the front door. If it is not possible to hand over the goods in person at the delivery time specified by DPD, a collection slip will be placed in the letterbox. The customer can use the collection slip to choose a second free delivery or a personal collection from DPD.

Compliance with delivery times

D.A.D. Foods and its delivery service partner DPD make every effort to comply with delivery times. However, all delivery times stated by D.A.D. Foods are indicative only. Orders may be placed in designated time slots that are limited by the food manufacturer’s production capacity. Due to the nature of the product and its long shelf life, D.A.D. Foods reserves the right to postpone delivery of the product for up to 30 days after the stated delivery date indicated when the order was placed. Customers will be informed by email of the exact delivery date by our exclusive delivery partner DPD Switzerland.

A breach of delivery times by D.A.D. Foods and its delivery service partner DPD does not entitle the customer to withdraw from the contract or to claim compensation.

Impossibility of delivery

If D.A.D. Foods, via its delivery service partner DPD, is unable to deliver an order due to an incorrect delivery address or inability to accept the delivery at the agreed delivery time or to collect it in person from DPD, D.A.D. Foods will not be obliged to carry out the delivery. In this case, the order will be cancelled by D.A.D. Foods. The customer will be notified by e-mail. The customer will not be entitled to any compensation as a result of this. The customer must provide correct information and comply with it. If the customer fails to comply with this obligation and D.A.D. Foods is therefore unable to deliver the order via its delivery service partner DPD Switzerland, D.A.D. Foods is entitled to cancel the order and retain the customer payment without the possibility of a refund.

4. Payment and prices

All prices are quoted in Swiss francs including the applicable value added tax. The prices charged are always those displayed on the online shopping website at the time the order is placed.

5. Customer service and complaints

Customer service provides information and personal advice on questions, problems or complaints regarding the online e-shop services. Customer service can be contacted as follows:

Defects must be reported immediately upon receipt of the goods, otherwise the goods shall be deemed accepted by the customer as being in perfect condition. Hidden defects must be reported to customer service immediately after their discovery. If the complaint is justified, the purchase price will be refunded to the customer. The customer must return the product to the above address at their own expense. The refund will be made to the payment method used.

6. Final provisions

Changes to the General Terms and Conditions

D.A.D. Foods reserves the right to amend these General Terms and Conditions at any time. Changes will be announced on the online e-shop website and will apply from the date of publication. The customer accepts the new provisions when placing the first order after the new General Terms and Conditions have been published.

Severability clause

Should any provision of these General Terms and Conditions be ineffective or invalid, the effectiveness of the remaining provisions shall remain unaffected.

Applicable law and place of jurisdiction

Swiss law is exclusively applicable. The place of jurisdiction for natural persons is Canton Zug or the customer’s place of residence. For legal entities, Canton Zug is the exclusive place of jurisdiction.
